Mobile Terms of Service

The Firecracker by Cali Banger mobile message service (the “Service”) is operated by Firecracker by Cali Banger (“Firecracker”, “Cali Banger”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Firecracker by Cali Banger’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Firecracker by Cali Banger through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. The service will include promotional messages such as promotions, specials, coupons, and other marketing offers.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Firecracker by Cali Banger. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18335730553 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Firecracker by Cali Banger mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

How and For What Purposes Firecracker by Cali Banger Uses Non-Personal Information:

We also collect information in a form that does not, on its own, identify any specific individual or household and could not reasonably be linked, directly or indirectly, with a particular individual or household (non-personal information) such as aggregate data and information about activity on the Websites.

We may collect, use, transfer, and disclose non-personal information to improve the Websites and customize the user experience, and for any other legitimate purpose. We also may aggregate non-personal information to track trends and analyze use patterns on the Website.

Firecracker by Cali Banger uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to assist in delivering the Websites. This service helps us better understand who and how people are using the Websites and how to improve the effectiveness of the Websites. Google may use cookies, pixel tags or other technologies to collect and store anonymous information, such as time of visit, pages visited, time spent using the Websites, type of operating system used, and other website(s) you may have visited. You may opt-out of receiving these messages at any time.

It may be necessary for Firecracker by Cali Banger to disclose your personal information by law, legal process, litigation, and/or requests from public and governmental authorities. We may also use and disclose information about you if we determine that use and disclosure are reasonably necessary to enforce our terms and conditions or other rights, or to protect the Websites or their users. This could include providing information to public or governmental authorities.

Additionally, in the event of a reorganization, merger, or sale of all or a portion of our business, we may transfer all personal information and non-personal information we collect to the relevant third party.   • Opt-Out of messages sent to your mobile device.

Not all personal information processed by Firecracker by Cali Banger can be accessed or controlled via the tools described above. We endeavor to substantively respond to a verifiable consumer request electronically within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable consumer request.

You must be either (a) a valid medical marijuana patient 18 years or older or (b) 21 years or older to create an account on the Websites.

Our Websites are not intended for individuals under 18 years old. We do not knowingly collect personal information from individuals under 18 years old. If you are under 18 years old, please do not provide any personal information to any of our Websites or, through any of its features, register on the Websites, make any purchases through the Websites, contact us through the Websites, or provide any information about yourself to us. If we learn that we have collected or received personal information from an individual under 18 years old, we will delete that information and the associated account. Users Outside of the United States:

The Websites and the servers upon which they are hosted are located in the United States and are not designed or intended for anyone outside of the United States. If you are outside of the United States, please do not provide personal information to us.
